PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE USING THIS GAME AND/OR COMPANION WEB SITE AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS.

THIS END USER LICENSE AGREEMENT SET FORTH THE TERMS AND CONDITIONS UPON WHICH WE, STUNLOCK STUDIOS AB AND ITS LICENSORS (COLLECTIVELY, “STUNLOCK STUDIOS AB”, “WE”, “OUR” OR “US”) PERMIT YOU TO DOWNLOAD AND INSTALL SOFTWARE AND RELATED ONLINE OR ELECTRONIC DOCUMENTATION (COLLECTIVELY, THE “GAME SOFTWARE” or “GAME”) IN CONJUNCTION WITH THE FEATURES AND FUNCTIONALITY OFFERED BY US (THE “SERVICE”) AT THE BLOODLINE CHAMPIONS WEBSITE AT WWW.BLOODLINECHAMPIONS.COM (THE “WEBSITE”).

THIS SOFTWARE IS LICENSED, NOT SOLD. BY INSTALLING, COPYING OR OTHERWISE USING THE GAME SOFTWARE (DEFINED BELOW), YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT PERMITTED TO INSTALL, COPY OR USE THE GAME SOFTWARE.

You are solely responsible for the compatibility of the hardware and software on your personal computer.

To be allowed to use the Service you must agree to this End User License Agreement, the Terms of Use and Privacy Policy.

Grant of a Limited License

This Service is intended for individuals 18 and older. If you are below 18, you agree that you have been granted permission by a legal guardian. On these condition and that you agree to the End User License Agreement, Stunlock Studios AB hereby grants you limited, non-exclusive, non-transferable and revocable license to: (a) download and install the Game Software on your personal computer, and (b) use the Game Software in conjunction with the Service and the Website. You may use the Service solely for your personal (non-commercial) purposes only.

Additional License Limitations

The license granted to you by this End User License Agreement is personal and subject to the following further limitations. You shall not or permit any other person to:

(a) reverse engineer, decompile, or disassemble the Game Software;

(b) modify or cause to be modified any files that are part of the Game Software in any way not expressly authorized by Stunlock Studios AB;

(c)modify or remove any copyright, patent, confidentiality, and other notices, labels or legends in the Game Software;

(d) sell, grant a security interest in or transfer reproductions of the Game or Game Software to other parties in any way not expressly authorized herein;

(e) assign, rent, lease or license the Game or Game Software to others;

(f) exploit the Game or Game Software or any of its parts for any commercial purpose, including, but not limited to, use at a cyber café, computer gaming center or any other location-based site without the express written consent of Stunlock Studios AB;

(g) host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by Stunlock Studios AB or its licensors in any way, including, without limitation, through protocol emulation, tunneling, packet sniffing, modifying or adding components to the Game, use of a utility program or any other techniques now known or hereafter developed, for any purpose, including, but not limited to, unauthorized network play over the Internet, network play utilizing commercial or non-commercial gaming networks or as part of content aggregation networks;

(h) use any unauthorized third party programs, including but not limited to “mods,” “hacks,” “cheats,” “scripts,” “bots,” “trainers,” and automation programs, that interact with the Software in any way, for any purpose, including but not limited to any unauthorized third party programs that intercept, emulate, or redirect any communication between the Software and Stunlock Studios AB and any unauthorized third party programs that collect information about the Game by reading areas of memory used by the Software to store information

(i) create or maintain, under any circumstance, any unauthorized connections to the Game or the Service. All connections to the Game and/or the Service may only be made through methods and means expressly approved by Stunlock Studios AB. Under no circumstances may you connect, or create tools that allow you or others to connect, to the Game’s proprietary interface or interfaces other than those expressly provided by Stunlock Studios AB for public use.

Your failure to comply with the restrictions and limitations listed above and elsewhere in this End User License Agreement shall result in immediate, automatic termination of the license granted hereunder and may subject you to civil and/or criminal liability.

Ownership and intellectual property rights

Stunlock Studios AB holds and retains exclusive right (including all intellectual property) in and to the Game Software. This includes (but is not limited to) bug-fixes, patches, updates, improvements, modifications, concepts, artwork, computer code, environment designs, animations, sounds, music, story-lines and similar conceptual work. All such work as mentioned previously in this paragraph belongs solely to Stunlock Studios AB, and are protected under Swedish national, but also other national and international, copyright laws. The Game Software may contain certain licensed materials, and the licensors of those materials may enforce their rights in the event of any violation of this End User License Agreement.

Except as expressly and unambiguously provided in this End User License Agreement, you are not granted any express or implied right, either by us or our licensors. Unless expressly granted by us or our licensors, all rights in the Game, Service and Website are retained.

Consent to Monitor

When You are using the Software, the Software may monitor Your computer's random access memory for unauthorized third party programs that interact with the Software or the Game. In the event that the Software detects an unauthorized third party program, information may be communicated back to Stunlock Studios AB, including the name of your account, your internet protocol (IP) address, details about the unauthorized third party program detected, and the time and date that the unauthorized third party program was detected, with or without additional notice to You. No other information about You or Your computer will be communicated to Stunlock Studios AB. If the Software detects the use of an unauthorized third party program, Your access to the Game may be terminated with or without additional notice to you.

Updates

Stunlock Studios AB may provide Updates to the Software that must be installed for You to continue to play the Game. You hereby grant to Stunlock Studios AB Your consent to install such Updates to Your computer without additional notification to You.

Amendments of the service

Stunlock Studios AB and its licensors may change, modify, suspend, or discontinue any aspect of the Game, Game Software and/or the Service at any time. Stunlock Studios AB may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability. You disclaim any right, title or interest, monetary or otherwise, in any feature or content contained in the Game, Game Software and/or the Service.

Termination.

This End User License Agreement are effective until terminated. You may terminate this End User License Agreement at any time by (a) removing the Game Software from your personal computer hard drive; and (b) notifying Stunlock Studios AB of your intention to terminate this End Used License Agreement. Stunlock Studios AB and/or is licensors may, at their sole discretion, terminate this End User Licens Agreement may terminate this Agreement at any time for any reason or no reason. In such event, you must immediately destroy and remove the Game Software from your personal computer hard drive. Upon termination of this End User License Agreement for any reason, all licenses granted herein shall immediately terminate.

Limited Warranty.

You are solely responsible for the compatability of the hardware and software on

your personal computer.

Stunlock Studios AB and its licensors expressly disclaim any warranty for the Service, Game or the Game Software and any components thereto. The Service, Game and Game Software are provided “as is” without warranty of any kind, either express or implied, including, without limitation, any implied warranties of condition, defects, use, merchantability, fitness for a particular purpose or use, or non-infringement. You assume the entire risk arising out of use or performance of the Service, Game and Game Software. Some states do not allow the exclusion or limitation of implied warranties, so the above limitations may not apply to you.

Limitation of Liability

To the full extent permitted by law, the User agrees that Stunlock Studios AB will not be liable for any damages (including, without limitation, damages for any indirect or consequential or exemplary loss, including but not limited to work stoppage, computer failure or malfunction, loss of business opportunities, data, goodwill, projects, or profits) howsoever arising and whether in contract, tort or otherwise from the use of, or inability to use, the Game, Website, Service or any of its contents and materials, or from any action or omission taken as a result of using the Service or any such contents, or any other matter relating to the Service.

Stunlock Studios AB and its licensors shall not be responsible for any interruptions of service, including but not limited to, ISP disruptions, software or hardware failures or any other event which may result in a loss of data or disruption of service. In no event will Stunlock Studios AB or its licensors be liable to you for any indirect, incidental, special, exemplary, punitive or consequential damages.

Equitable Remedies

You hereby agree to indemnify and hold Stunlock Studios AB and its licensors harmless from and against any liabilities, damages, judgments, losses, costs and expenses (including reasonable attorneys’ fees) arising out of your download, installation and use of the Game Software in a manner inconsistent with this End User License Agreement.

In the event any litigation is brought by Stunlock Studios AB or its licensors in connection with this End User License Agreement and either is deemed a prevailing party, each shall be entitled to recover from you all the costs, attorneys’ fees and other expenses it incurred in such litigation.

Changes to the Agreement

Stunlock Studios AB and its licensors reserve the right, at their sole discretion, to amend, add or delete any of the terms and conditions of this End User License Agreement when the Game Software is upgraded, effective upon prior notice as follows: Stunlock Studios AB will post notification of any such changes to this End User License Agreement on the Website and will provide a link to the revised version of this End User License Agreement, and may provide such other notice as Stunlock Studios AB in its sole discretion may elect. If any future changes to this End User License Agreement are unacceptable to you or cause you to no longer be in compliance with this End User License Agreement, you may terminate this End User License Agreement in accordance with the terms herein. Your installation and use of any updated or modified Game Software or your continued use of the Game Software following notice of changes to this End User License Agreement as described above means you accept any and all such changes.

Miscellaneous

This End User License Agreement shall be governed by, construed and enforced in accordance with the laws of the Sweden, as they are applied to agreements entered into and to be performed entirely within Sweden. Any action you, any third party or Stunlock Studios AB may bring to enforce this End User License Agreement or, in connection with any matters related to the Service shall be brought only in Courts located in Sweden, and you expressly consent to the jurisdiction of said courts.

If any provision of this End User License Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this License Agreement and shall not affect the validity and enforceability of any remaining provisions.

The failure of Stunlock Studios AB to exercise or enforce any right or provision of this End User License Agreement shall not constitute a waiver of such right or provision.

This End User License Agreement and the Terms of Service contain the entire agreement between the parties relating to use of the Service, Game, Game Software and Website and the matters set forth herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Stunlock Studios AB with respect to the Service and the Materials. To the extent that the provisions of this Agreement conflict with the provisions of the Terms of Use, the conflicting provisions in the Terms of Use shall govern.
